AN ORDINANCE ESTABLISHING THE FULL-TIME POSITION OF VILLAGE ADMINISTRATOR, DEFINING DUTIES AND AUTHORITY, PROVIDING FOR APPOINTMENT AND COMPENSATION, AND DECLARING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY WHEREAS, Ohio Revised Code $ 735.271--735.273 authorize a village to create the position of Village Administrator and to assign executive, administrative, and operational duties; and WHEREAS, the Council of the Village of Sabina finds that the efficient management of municipal operations requires a full-time professional administrator to oversee public works, utilities, personnel, procurement, and daily operations; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SABINA, ?HIO: Section 1. Establishment of Position. There is hereby created the full-time position of Village Administrator ("Administrator"). The Administrator shall serve as the chief administrative officer of the Village and shall perform the duties set forth in this Ordinance and in the Ohio Revised Code. Section 2. Appointment; Term; Removal. The Administrator shall be appointed by the Mayor with the advice and consent of Council, pursuant to ORC 735.271. The Administrator shall serve at the pleasure of the Mayor, subject to removal by the Mayor; however, Council may remove the Administrator by a two-thirds vote as provided in ORC 735.273. The Administrator shall not be required to be a resident of the Village at the time of appointment but may be required to establish residency within a reasonable period if Council so directs. Section 3. Compensation and Benefits. The Administrator shall receive compensation as established by separate ordinance or annual appropriation measure. The Administrator shall be eligible for all employee benefits afforded to full-time Village employees unless otherwise provided by ordinance or contract. The Administrator may delegate duties to subordinate employees as necessary for efficient operations but shall remain responsible for the proper execution of all assigned duties. Section 6. Conflict of Laws. Any ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. Section 7. Effective Date. This Ordinance shall take effect at the earliest period allowed by law. Section 8. Misc. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council and that all deliberations of the Council and any of the decision making bodies of the Village of Sabina which resulted in such formal actions were in meetings open to the public in compliance with all legal requirements of the State of Ohio. Section 9. Emergency This Ordinance is hereby declared to be an emergency measure and its passage is immediately necessary in order to preserve, protect and maintain health, safety and welfare of the citizens of the Village of Sabina, Ohio, and to provide for adequate management of Village services, and therefore the same shall be in full force and effect immediately.
