Title: Bankruptcy/Probate Specialist

Job Summary: Responsible for overseeing and protecting the Credit Union's interests in bankruptcy and probate matters. Ensures maximum dollars collected, minimizes potential losses, and maintains compliance with bankruptcy laws.

All job positions at 7 17 Credit Union may be assigned further duties with or without notice, verbally or in writing. Essential duties and responsibilities include the following.

Primary Duties:

  • Identify, code, and document bankrupt accounts through mail correspondence or electronic court notifications on all pertinent systems. This includes, but is not limited to, coding for TDRs and credit reporting purposes.
  • Prepare bankruptcy proof of claims, reaffirmation agreements, and other bankruptcy related documents as required.
  • Review bankruptcy cases ensure that the Credit Union is protected, and minimizes losses
  • Review Chapter 13 Plans to ensure the Credit Union's interests are protected as provided under applicable Bankruptcy Law.
  • Oversee and account for payments received from Bankruptcy Trustees on Credit Union loans that included in Bankruptcy plans.
  • Prepare and file agreements, notices and other required documentation on behalf of the Credit Union in bankruptcy proceedings.
  • Communicate and follow-up with Bankruptcy Trustee(s) and Member's Bankruptcy Counsel in regards to Bankruptcy matters related to the Credit Union.
  • Communicate and follow up with in-house attorney, loan servicing recovery staff, and collection staff until bankruptcy is closed and discharged.
  • Identify, code and document deceased/probate accounts via mail or electronic notification on all pertinent systems.
  • Review probate matters, identify assets, locate estates, and file proper claim documents. Also recommend if the Credit Union should open an estate and oversee as its executor.
  • Oversee and follow up on probate/estate matters, within required time frames and tracking dates to minimize losses.
  • Contact attorneys or family members of deceased members to discuss status and intentions, while maintaining communication as needed.

Secondary Duties:

  • Research, document, flag and memo bankrupt accounts. Discuss Credit Union policies and procedures with members as needed.
  • Attend court or court related proceedings, when needed, to ensure the Credit Union receives adequate protection
  • Collect on charged off accounts.
  • Assist legal department as needed with the preparation of legal pleadings, motions and related documents.
  • Travel to various courts or government offices to file legal pleadings, motions and related documents.

Confidentiality Require ments: Must keep members' transactions and other Credit Union business in strictest confidence.

Travel Demands: Must be able to travel locally.

Prerequisite Education: High school diploma or equivalent

  • Must have at least 3 years with bankruptcy matters; including filing proof of claims, attending bankruptcy court, and interpreting cases.
  • Proficient in probate law and filing estate claims preferred.
  • Collection/recovery experience, or real estate lending experience, or consumer lending preferred.

Other Prerequisite Requirements of the position:

  • Strong knowledge of consumer, residential, commercial, dealer-originated lending as applicable.
  • A solid understanding of state and federal laws pertaining to collection of debt.
  • Excellent negotiation skills.
  • Professional verbal and written communication skills.
  • Experience with credit bureaus and skip tracing.
